We "saved a young man from a felony".

Aloha. I'm also including this (former) 'open case' here in the 'testimonials' because, as his lawyer said, we "saved a young man from a felony".

Some THC Ministry 'open cases' go on and we don't ever hear of the results because the defendant doesn't communicate with us. Yesterday I wrote to the lawyer in this Kentucky case to see what happened. Here is her answer.

Is this a success for our ministry? You decide.

It's good to hear from you.

'John Doe' couldn't make it back to Kentucky from his home state of Florida and the court denied my 'motion to dismiss' based on 'religious grounds'.

However, they did allow me to enter a plea of 'guilty' without my client's appearance in court. He got no jail time and a small fine and court costs all paid out of his bond.

He really did not want to plead guilty, but a fugitive from justice warrant would have been issued on a FELONY if we hadn't entered a plea in abstentia (without the defendant's presence), plus he wasn't able to pay for an appeal of the court's denial of our 'motion to dismiss'.

Everybody here liked the motion, even the prosecutor. Got them thinking.

After all was said and done, nothing bad happened to my client and that was very important to me. He was a very peaceful and polite fellow.

However, he had a prior 'possession of cannabis' charge on his record from
another state and the prosecutor wanted to upgrade his charges to a
felony because ... GET THIS! ... in the state of Kentucky a second offense for possession of cannabis is a FELONY - regardless of what jurisdiction or
state the earlier possession conviction was in.

After the prosecutor responded to our 'motion to dismiss', however, he decided not to upgrade the charges to a felony against John Doe.

So, thanks very much for all the info. It saved this young man from a felony which is something he definitely did not need for having a little bit of cannabis on him.

Well I would definatly call that a success. A felony charge is an awful thing to have hanging over ones head. Job wise its very harmful.

Sometimes it seems like these prosecutors are just playing games with peoples lives. What charges can they dig up and how can they be twisted? If they fail, they just move on to the next victim. If they win there demonic cause, they dance.

May G-d have mercy on these people on judgement day, because neither the DEA(th) nor the fed will be there for them as there true vial nature spills out before G-d like vomit. Our poor Lord, why must these things be inflicted on him?

I think it is a clear victory...They had the opportunity to pursue a felony conviction on this person, and any other time they would have...But they got a whiff of the defense that would be used in front of 12 jurors if they did, and said "No, thank you". Smart move on their part.
