Medical marijuana crusader Steven Wynn Kubby was ordered to return to jail Wednesday to serve a 60-day sentence for violating probation when he moved to Canada to avoid serving time for a drug conviction.
Kubby was released from the Placer County Jail on March 6 after serving a third of his 120-day sentence, because of good behavior and overcrowding at the jail.
Superior Court Judge Robert McElhany imposed the new sentence Tuesday. Kubby fled to Canada in 2001, saying he could die in jail without access to the medical marijuana he uses to treat a rare form of adrenal cancer.
Kubby was placed on three years' probation before he left Canada to avoid jail time, prosecutor Christopher Cattran said Tuesday. He called the 60-day term for violating probation "a little light."
"I believe there should be a just sentence for what he did. He was gone for five years," Cattran said.
Kubby had applied to stay in Canada but was deported in January.
While in the Placer County Jail, Kubby took Marinol, a prescription drug that contains a synthetic form of THC, the active ingredient in marijuana. Kubby said it was helpful but did not provide the degree of relief he gets from cannabis.
"To have gone more than 40 days in jail with just Marinol would have been impossible for me. I was at the limit," he said.
