SALINAS, Calif. (AP) -- A Salinas man will have to choose between going to jail or joining the military as his punishment for possession of marijuana.
A judge surprised both the prosecution and defense yesterday when he told Brian Barr that he could avoid a jail term by enlisting in the military.
The 24-year-old Barr was charged with marijuana possession after shooting a would-be robber who had entered his apartment with two others.
Police say Barr sold marijuana from his home, and that the three men were searching for money and marijuana.
In giving Barr a choice of sentence, Monterey County Judge Robert Moody said that the shooting was justified.
Barr is scheduled to return to court next month.

Sounds like a decent judge but the so-called choice of sentence still sux. Like what, this young man seems to be pretty handy with firearms so maybe we should incorporate him into the killing of innocent men, women, children and other helpless life-forms. Gee, what a bargain.
They should be giving him some kind of medal or award if ya ask me. Sounds like the kind of person I wouldn't mind having for a neighbor. _________________ "The world's religions have done more to harm humankind than to help it."

That is absolutely dispicabal. Thats the same as saying YOU GET 2 CHOICES YOU CAN CHANCE ANAL RAPING OR DEATH.  _________________

Amen to that ,Romadon.But no medal for marksmanship, he only capped on one out of three.Of course in baseball, .333 batting average is pretty good...maybe I am being too hard on him.
I think if you come into someone's home to rob-especially a dealer, you should expect to get shot.
If you want to take someone's money and marijuana, you are probably a wannabe politician or drug warrior, best those evil aspirations get nipped in the "bud" anyway,IMO.  |

This is nothing new it has straightend out alot of troubled youths in there time. I know alot of people that were given this option when they got into trouble with the law. (my dad is 1). And back then it was Vietnam. _________________ "I didn't inhale" or "oral sex is not adultry"

Well if I gotta chose between military and prison I'll most likely go with military. But I still have this objection to killing women and children and even some men I suppose. I almost went to Nam myself but had to stay home for my mom and brother. I have been bitter about it at times because some of my family are war hero's and it was me who got spat on at home.
My mind set was different back then but if I had to kill women and children I always like to think I would turn on my own men or commanding officers and kill them instead. That was a long time ago I don't even know who or what I was back then. I also realize if little children are running towards you and you have know idea whether or not they are loaded with explosives can be a big incentive to just blow them away rather waiting till it's too late to find out. _________________ "The world's religions have done more to harm humankind than to help it."
