hello everyone! i have a question. besides being a sacrement, i consider cannabis to be the best possible medicine for all of my problems.......i have panic disorder, GAD OCD fybromyalgia, insomnia, and eating problems. without cannabis, i would never sleep. even sleeping pills dont work. without cannabis, i could not get ou of bed because my pain level is too high without the herb. without cannabis i oculd never eat because i have an incredibly messsed up stomache. and on top of it all, it kills the anxiety, and i have been able to cut down from 6 to 3 mg of klonopin since i started using herb with it. i hope to be just using herb some day. so anyways my question is, are any of these conditions good enough to warrant a medicinal card in say, california? what states have the best med laws? do you think i stand a chance? this is my medicine and i will use it no matter what, but i would really love to use it medicinaly legally. i am willing to move to any state. what do you people think? thank you!

I think that you have all the rights in the world to use Cannabis for medicinal reasons, and specially in the state of California.

Where are you in California? I'm sure we have members in your area who can help you with more information.

Since 1996, eleven states have legalized medical marijuana use: AK, AZ, CA, CO, HI, ME, NV, OR, RI, VT and WA. Eight of the ten did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000. Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004. Rhode Island's was enacted overriding the governor's veto in January 2006.

Maryland allows a legal defense for medical use if you get arrested.

You could go to one of these states or simply go to the nearest sanctuary.

Aloha. Your question has a pretty simple answer. As far as I know, Mendocino County California is THE best place in the U.S.A. to be a Cannabis enjoyer.

I was just there for a quick tour and I saw with my own eyes what Cannabis liberty looks like. It's awesome! It's powerful. It's healing. It's profitable. Even the Sheriff and the District Attorney agree that people can grow herb and sell it to medical clubs there legally. Think of that. Legally. Grow. Enjoy. Sell and profit. Long season. Go now!

But the question:

Can you smoke it if you do not have a medical condition?

Of course the drug industry can make new "diseases" like "sleeping leg syndrome", but what if I claim I have "limp penis syndrome" when I don't smoke my Cannabis?

Of course. Hypocrisy which we already know.

As far as I know, EVERY citizen of Mendocino County is allowed by law to grow and enjoy 25 Cannabis plants in their yard without any reason at all. The citizens passed a local initiative a few years ago. Go Mendo! That's how people-power can actually work effectively for the people, by the people.

MARIJUANA ORDINANCE FOR MENDOCINO COUNTY
Section 1: FINDINGS.

The people of Mendocino County find as follows:

* WHEREAS Cannabis sativa (marijuana) is a beneficial plant with a respectable heritage and hundreds of well-known industrial, medicinal and recreational uses;

* WHEREAS two decades of marijuana law enforcement in Mendocino County has not stopped cultivation here but has unnecessarily marginalized a large number of otherwise law abiding citizens who grow and use marijuana;

* WHEREAS those who grow for personal use are not responsible for violent incidents sometimes associated with marijuana cultivation, but are vulnerable to theft;

* WHEREAS The Institute of Medicine has found that marijuana has bona fide medical uses and is not a gateway to hard drug addiction;

* WHEREAS law enforcement has carried out investigations, confiscations, and arrests against persons cultivating and using medical marijuana under Proposition 215 in Mendocino County;

* WHEREAS the cities of Berkeley and San Francisco have longstanding ordinances which instruct police to minimize the priority of marijuana enforcement.

Section 2: PURPOSE

The ordinance codified in this chapter will:

A. Instruct the county government to support all efforts toward the decriminalization of marijuana;

B. Instruct the county sheriff and district attorney to make marijuana enforcement their lowest priority with respect to other crimes;

C. Establish a maximum limit of plants and weight for cultivation and possession of marijuana for personal use in Mendocino County, and prohibit the expenditure of public funds for enforcement of marijuana laws against cultivators and users in possession of quantities below that limit.

D. Remove the fear of prosecution and the stigma of criminality from people who harmlessly cultivate and/or use marijuana for personal medical or recreational purposes.

E. Extend police protection to those growing or possessing marijuana for personal use;

F. Provide for the continued enforcement of marijuana laws against those who cultivate, transport and possess marijuana for sale.

THEREFORE: the purpose of this chapter is to establish Cannabis enforcement policy for Mendocino County.

Section 3: DECRIMINALIZATION OF CANNABIS IN CALIFORNIA

It is the desire of the people of Mendocino County that the cultivation for personal use of Cannabis be decriminalized in California. In this context, the board of supervisors is directed to lobby state and federal governments for the immediate decriminalization of the personal use of Cannabis, specifically by repealing Sections 11357, (possession), 11358, (transportation), and - 11359, (cultivation), of the California Health and Safety Code. The people also urge the Sheriff and District Attorney to publicly support such decriminalization.

Section 4: LAW ENFORCEMENT PRIORITY OF CANNABIS

Through its budgetary authority, the Mendocino County Board of Supervisors shall seek to ensure that the Sheriff's Office and the District Attorney give lowest priority to the enforcement and prosecution of marijuana laws.

Section 5: SHERIFF OFFICE ARRESTS AND CITATIONS

The Board of Supervisors shall use its budgetary authority to ensure that the Sheriff's Office makes no arrests and issues no citations for violations of the above state Health and Safety Code sections in any single case involving 25 or fewer adult flowering female marijuana plant or the equivalent in dried marijuana.

Section 6: DISTRICT ATTORNEY PROSECUTIONS

The Board of Supervisors shall use its funding authority to ensure that the District Attorney shall not prosecute any violations of the above state Health and Safety Code sections nor seize any property in any single case involving 25 or fewer adult flowering female marijuana plants or the equivalent in dried marijuana.

Section 7: EXPENDITURE OF FUNDS FOR CANNABIS ENFORCEMENT

Neither the Mendocino County Board of Supervisors, nor the Sheriff, nor the District Attorney shall spend or authorize the expenditure of any public funds for the investigation, arrest, or prosecution of any person, or the seizure of any property in any single case involving 25 or fewer adult flowering female marijuana plants or the equivalent in dried marijuana, nor shall the Auditor Controller or the Treasurer- Tax Collector approve any such requests for such expenditures of public funds, or authorize or approve the issuance of any form of payment should such expenditures be made.

Section 8: REPORTING

The Board of Supervisors shall instruct the Sheriff's Office and District Attorney to report on December 1 of each year regarding marijuana law enforcement and prosecution activities engaged in by themselves and by state, federal, and/or other law enforcement agencies within the County of Mendocino.

Section 9: SERVERABILITY

The people of Mendocino County intend that in case a court of competent jurisdiction should find one or more of the above Sections illegal, the remaining Sections remain in full force and effect.

How do we go about legalizing Hemp in our local communities?

If enough of us "pulled up the boot straps" and got to work, it would certainly generate the required interest.

Lastly, and I apologize for splitting this up into 3 posts, the research I have done on Medincino county has suggested that the feds have raided several individuals there, because, they do not agree, nor do they abide, by the local law.

So it could be entirely possible that you have plants in your yard, and you could be arrested, and sentenced, by the federal govt.

Could you elaborate Roger since you were there personally?

aloha everyone! thank you all for being so kind. i have work i need to finish up first but as soon as i do, i will have the money and me and my beautiful lady ARE heading for mendecino........ive always known how tolerant north cali is, and they have some of the finest smoke i have ever enjoyed, but i had no idea that you could legaly grow in certain places. its so beautiful. each day it seems a little more of the world wakes up. many countries, and states are becoming more tolerant. ssooon, brothers and sisters, we will all live in freedom and peace and bliss. thank you so much for telling me about your friends in mendecino. when its time to go there, i may just get back with you and see how to contact the ritcheous people. blessings to you all. merry toking

We did NOT legalize hemp here. We DID get legislation passed at the State level back in the 1990's to have an experimental hemp farm here. It operated for about four years and then shut-down due to pressure from the D.E.A. over their "permit" to operate.

The D.E.A. paperwork run-around confused the investors of the project (Alterna Shampoo Company of L.A.) and they, and Dave West, the Ag specialist who ran the facility, gave-up in frustration.

My recommendation; if you want to grow industrial hemp, do it for religious purposes. Get your Ministry paperwork in order and be pro-active. Sue for the right to do it, or you can lobby your legislature to pass a new law. As far as I know the State of North Dakota has already voted to legalize industrial hemp. Now they're waiting on a permit from the D.E.A. Zzzz-Zzzzz...

This is a really huge issue and, as far as I know, there are zero industrial hemp farms operating in the U.S.A. today. Zero.

There ARE, however, "legal" medical marijuana farms and gardens, especially in Mendocino.

Which would you rather have if you had to choose one?
