U.S. District Judge James Mahan has ruled that two Nevada petition requirements that prevented a marijuana initiative from qualifying for the November ballot are unconstitutional, the Associated Press reported Aug. 14.
However, Mahan stopped short of ordering Nevada Secretary of State Dean Heller to include the marijuana measure on the Nov. 2 ballot.
The initiative would allow Nevada adults to legally possess and use up to one ounce of marijuana.
Organizers of the initiative failed to meet the state's "13-counties rule." Under the rule, signatures for ballot initiatives must be obtained from at least 10 percent of the number of voters who cast ballots in the most recent general election in at least 13 of Nevada's 17 counties.
But Mahan ruled that the 13-counties rule was a violation of the federal Constitution's "equal protection" clause ensuring one-person, one-vote. He also ruled that the state's "dual affidavit" requirement was unconstitutional. Under the requirement, a registered Nevada voter is required to sign each petition and a separate document attesting to the validity of the name on the petition.
Mahan said the statewide total of 66,000 marijuana-petition signatures submitted should be counted towards the required 51,337 valid signatures needed. "If you've got the signatures, then it's on the ballot," said the judge.
County election officials now have until Aug. 31 to verify the petition signatures.
