Brother JB, I do suspect that the officer was either a) over-worked, b) deliberating trying to cause trouble, or 3) a bone-head. Either way, you have God and the law on your side. Since you live in the grand ol' US of A and not some 3rd world country, all citations are required to have a copy. It maybe a carbon copy or electronic, but there is always a copy!
This 'dated' copy would be numbered and must fall in sequence between the two other numbered and dated copies that should fit the sequence. For example: citation 1 dated 02/02/07, citation 2 (yours) is dated 01/07/07, and citation 3 is dated 02/02/07. I'm sure you get the point of this example.
Even though the officer in question should bring his citation copies, You need to request a copy of his copies from the register or whatever they call it where you live.
Something I learned from an attorney friend of mine. Snowball them with paperwork and 'evidence'. Bring all receipts, documents, and other scraps of paper relevent to that week, not just that day. Take photos of where the incident took place, anyone else who was even remotely involved, streets, whatever, pack them up nicely in a briefcase. And if you have witnesses, bring them in!
Rehearse what you will say to the judge and keep it SHORT (if this is the first time before the judge, it may most likely be a plea after which they will set another date for a hearing). But if you get to say more, hold back all personal emotion, be professional and concise.
In many states, if the copper doesn't show, the case is thrown out. There is always that possibility... especially if he's over-worked enough to make such a grievous error. _________________ "Penalties against the possession of a drug

man the 5-0 don't have anything better to do, where i'm from. They ALWAYS show; and I think my county is something like the 3rd largest in the nation. You'll do fine, God has faith in you, so long as you have unquestionable faith in him. Even if not......... I have faith in you.
and remember, even if you have to plea your case, the fact that the cop didn't know what day/month it was, discredits him quite a bit. |
